Tax Audit Under Section 44AB: Who Needs One and What It Costs in India

Chandwani & Company Chartered Accountants in Bhopal 31 Oct 2026 7 min read

A Bhopal trader closes the year at ₹1.2 crore of sales and files his return in July, the way he always has. In October, his bank asks for a tax audit report to renew a loan. There isn't one, and a penalty clock has already started.

Tax audits catch honest businesses off guard because the trigger is turnover, cash handling and the scheme you filed under, not how tidy your books are. This guide covers who needs one, which limits apply, the dates, and what it costs, drawn from the audit desk at Chandwani & Company Chartered Accountants in Bhopal.

Who Needs a Tax Audit Under Section 44AB?

A tax audit under section 44AB is a mandatory audit of your books by a practising Chartered Accountant, required when turnover, gross receipts or your presumptive-income position crosses limits in the Income-tax Act, 1961. The CA files the report on the income tax portal before your return.

What Is the Section 44AB Turnover Limit?

For FY 2025-26 (AY 2026-27), the section 44AB turnover limit for a business is ₹1 crore. It rises to ₹10 crore if cash receipts and cash payments are each 5% or less of the total. For professionals, the test is gross receipts, and the limit is ₹50 lakh.

Turnover means sales, not profit. A trader earning a 2% margin on ₹1.4 crore of sales still needs the audit. First-time cases usually go wrong right here.

Another detail beginners miss: turnover is counted across all your businesses together. Two shops each at ₹60 lakh look safe on their own, but combined they cross ₹1 crore and the audit applies unless the cash test lifts your limit to ₹10 crore.

Does Presumptive Taxation Remove the Audit?

Presumptive taxation under sections 44AD and 44ADA lets small taxpayers declare income at a fixed share of turnover. Tax audit applicability returns if you declare less than the prescribed rate (6% or 8% for 44AD, 50% for 44ADA) and your income exceeds the basic exemption limit.

At Chandwani & Company Chartered Accountants in Bhopal, we see one trap repeatedly. A shopkeeper declares 6% for two years because it is easy, then switches to regular books to show a lower profit. Under section 44AB(e), that opt-out can pull him into audit for five years. It is a five-year decision, not a one-year one.

What Is the Tax Audit Due Date for FY 2025-26?

The original date for the audit report was 30 September 2026. On 28 September 2026, the CBDT extended it to 21 October 2026, and moved the return date for audit cases from 31 October to 21 November 2026.

These are two separate deadlines, and the report must be furnished first. If you are reading this after 21 October without a filed report, speak to your CA the same day. Dates can shift, so confirm against official notifications.

Extensions like this one appear on the firm's tax news page as soon as they are issued, which is where clients should check the tax audit due date before planning sign-offs.

What Is Form 3CD and What Does the Auditor Check?

Form 3CD is the statement of particulars attached to the audit report. It travels with Form 3CA if your books are already audited under another law, or Form 3CB if they are not.

The tax audit report form 3CD runs past 40 clauses. Auditors verify cash payments above ₹10,000 under section 40A(3), cash loans above ₹20,000, TDS compliance, GST reconciliation, depreciation and brought-forward losses.

Owners often confuse this with a company audit. A statutory audit versus tax audit comparison helps: one tests whether accounts are true and fair, the other whether the Income-tax Act was followed. A private limited company usually needs both.

In practice, the audit stalls on paperwork, not on law. Missing purchase bills, unsigned loan confirmations and bank accounts nobody mentioned are the usual causes. Giving your CA a complete bank and ledger list in week one saves days later.

How Much Does a Tax Audit Cost in India?

No fee is prescribed. Cost depends on transaction volume, bank accounts, branches and how clean the books are. As an illustration only, a small trading firm with tidy accounts might pay ₹15,000 to ₹40,000, while a multi-branch business with heavy cash and TDS work pays several times that. These are not quotes.

The cheapest audit is rarely the cheapest outcome. Books handed over in March with unreconciled GST cost more audit hours than books kept monthly. Ask what the fee covers, including review of the return and any notices that follow, and whether the signing CA has capacity, since ICAI caps a CA at 60 tax audit assignments a year.

What Happens If You Miss the Tax Audit?

Section 271B imposes a penalty of 0.5% of turnover or gross receipts, capped at ₹1.5 lakh, unless you show reasonable cause. Lenders also ask for the report, and a loan renewal can stall without it. Reasonable cause is judged case by case, so never plan around it.

Once the report is accepted, the audited figures feed your income tax return filing. File only after the CA confirms the report status, because mismatches between the audited profit and loss account and the return draw processing queries.

What Changes From Tax Year 2026-27?

From 1 April 2026, the Income-tax Act, 2025 applies. Section 44AB becomes section 63, and Forms 3CA and 3CB are replaced by Form 26. Commentators differ on how far the audit triggers change for businesses declaring below presumptive profit, so have your CA re-test applicability for FY 2026-27 instead of reusing last year's answer. Even a business safely under the limit this year may cross it next year if growth is strong, so the test is annual, not one-time.

What Should You Do Before the Next Audit Cycle?

  1. Total turnover or gross receipts across every branch and registration under one PAN.
  2. Test cash receipts and payments against the 5% threshold.
  3. Confirm whether you filed under 44AD or 44ADA, and at what rate.
  4. Reconcile bank statements, GST returns and TDS monthly.
  5. Appoint your auditor by April, not at the deadline.

Not Sure Whether Your Books Need an Audit?

If you have just realised your turnover crossed the limit, or cannot recall which scheme you filed under, a short review now costs far less than a penalty later. Send your turnover, cash ratio and last year's return to info@chandwani.co or call 9826677887, and our team will tell you plainly whether an audit applies.

Frequently Asked Questions

Q1. Is a tax audit compulsory if my business made a loss?

A1. Yes, if turnover or gross receipts cross the limit. The trigger is turnover, not profit, so a loss does not exempt you. Presumptive taxpayers declaring low income face a separate audit test linked to the basic exemption limit.

Q2. Does an LLP or partnership firm need a tax audit?

A2. The same section 44AB limits apply to firms and LLPs. An LLP may also need a separate audit under the LLP Act if turnover exceeds ₹40 lakh or contribution exceeds ₹25 lakh, so check both.

Q3. Does GST count in turnover for the tax audit limit?

A3. It depends on your accounting method. If books record sales net of GST (exclusive method), the GST collected is excluded from turnover. Treatment under ICAI's guidance note varies, so your CA should confirm the method before testing the limit.

Q4. Can I file my ITR before the audit report is uploaded?

A4. In practice, no. The report must be furnished on the portal first, and the filing system checks this against the due dates. Treat the report and return as a fixed sequence, with the audit always coming first.

Q5. Can any CA sign my tax audit report?

A5. Only a practising Chartered Accountant holding a certificate of practice can sign it. Ask for the membership number and check it on the ICAI website. A tax consultant who is not a CA cannot sign, however experienced they are.

Q6. Can my statutory auditor also do my tax audit?

A6. Yes. Many companies use the same CA firm for both, and the tax audit report then goes with Form 3CA because the books are audited under the Companies Act. Confirm that the engagement letter lists both assignments.
